Minutes for August 27, 2014 Selectmen’s Meeting

The meeting was called to order at 7:03 PM.

  • Discussion held between 5:00 & 7:00 p.m.
At 5 o’clock Tom Kennie, our Public Works Director came in to give the Board an update on the work that has been done on Cemetery Road, the property they were cleaning up.  All of the tires have been removed.  They have cleanup to do around the house and once that is done they will be moving on to determine what to do with the building.

At 5:30 our Treasurer, Charisse Keach gave the Board an update on some policies they need to review and the audit field work that was done in the past couple of weeks.  Selectman Harmon said it gets smoother and smoother each year as far as the work the auditors have to do that we haven’t done.  The Treasurer also talked about updates on selling a couple of town owned properties and some information she needs regarding time sheets.


At 6:00 a resident came in who was looking for answers in regards to trash pick-up on a private road.  The Selectmen explained what the process is as far as the town accepting the road and what the timeframe would be.

Selectman Booker said the Public Works interviews the Board did last week went very well.  

Selectman Booker reported that she attended a meeting on Monday regarding use of the Buxton Center Elementary School as a regional emergency shelter.  She said representatives from the Red Cross, EMA, and representatives from the Town were there.  They walked through the portion of the school that would be used for an emergency and were pleased with what they saw.  She said she expects that there will be some follow-up on that.

Last Friday, Selectman Booker attended a meeting with our Recreation Director and Chris Carroll from the Planning Board.  Meg Nadeau from the University of New England came in.  She has done a rural active living assessment of this area.  Selectman Booker explained the purpose of that and said they will be working on detailing five or six roads to determine if they are user friendly for walking, biking, and other activities.  For doing that, the town is eligible for a $1,000 grant that can be used for things like signage in the parks, building trails in the parks or anything that would have to do with healthy living.

Selectman Santolucito reported that he went out to the Cemetery Road property Sunday.  He said they are doing a great job getting it cleaned up and they are making a lot of progress there.

Selectman Burns talked about the interviews for Public Works said said Tom Kennie has made a selection.  

Selectman Burns mentioned the meeting regarding use of the school for an emergency shelter.  He said the Police Chief was there along with the Fire Chief, Sheridan Bennett, four representatives from the Red Cross, the Superintendent, and Assistant Superintendent of SAD 6.  They made the rounds at Buxton Center, went to the Hanson School and Frank Jewett School.  He said the Board will be getting something in writing from the Red Cross.  


Selectman Burns reported on some other things he has been doing.  He has been up to the Cemetery Road property several times this past week and said he was there earlier today when the last tractor trailer load of tires were taken out.  Also, he spoke with a resident today who was concerned about the Time Warner franchise fees.  He said they had a long conversation and he is going to get back to her with some information she asked for.

Selectman Harmon has been working on getting the carry-forward information and said a copy is going out to all the Department Heads.  She reported that our tax bills have gone out and she did her first abatement today.  She said there was an error on a tax bill and she is glad the resident was able to find it and get it corrected.  She reminded taxpayers that it is their responsibility to make sure the information on their tax bill is correct.

Selectman Harmon said she spoke with Cliff Thomas today about an overhead projector and screen for the Planning Board to use in the large meeting room.   Larry Curtis, who is also on the Planning Board had talked with Peter Burns about that several months ago, prior to the town receiving any money from Time Warner.  Cliff Thomas wanted to know how to go about getting the equipment.  She told him to send information on the equipment and the cost to Peter Burns so that he will get it purchased and installed.  

Selectman Emery has been working out of town for the last week but he has been calling in every day to keep up on what’s going on.  He said he talked to the Public Works Director about the lot up in Chicopee and talked to the Fire Chief once about that, and again on some other items.

Selectman Emery asked the other Selectmen if they would consider having a workshop next Tuesday.  After a brief discussion, they agreed to meet for the workshop Tuesday, September 2nd at 6:00 PM.


  • Old Business
Demolition of old Town Garage – To be discussed at the Board’s workshop

Davis Road – This is ongoing.  Fred Farnham is still trying to get in touch with the owner and the Selectmen are doing all they can at this point.  Selectman Emery said it is a work in progress and they will keep this in front of them and won’t forget about it.

School started today and the Board asked everyone to drive cautiously.

E.O. 141508022 – An order to approve a Victualer License for Chefas Inc., residing at 405 Portland Road, Buxton

E.O. 141508026 – An order to authorize the Lease Purchase of One (1) 2015 E-One Pumper Tanker in the Principal Amount of Up to $260,000 and vote as follows:  That under and pursuant to the provisions of Title 30-A of the Maine Revised Statutes of 1964, as amended to date and authorization of the voters of the Town of Buxton at the annual meeting on June 14, 2014, the Chair of the Board of Selectmen be and hereby is authorized to execute and deliver a tax-exempt lease purchase agreement with Tax-Exempt Leasing Corp., or its nominee, in the name and on behalf of the Town of Buxton, for one (1) 2015 E-One Pumper Tanker, said lease purchase agreement to be in the aggregate principal amount of two hundred sixty thousand dollars ($260,000) payable over a term not to exceed four (4) years with interest at an annual rate not to exceed 2.54%, and otherwise in such form and on such terms not inconsistent herewith as the Chair of the Board of Selectmen in consultation with the Town’s legal counsel deems to be in the best interests of the Town; and that the tax-exempt lease purchase agreement issued pursuant hereto be designated as a qualified tax-exempt obligation within the meaning of Section 265(b)(3) of said Code; and that the Clerk of the Town be and hereby is authorized to execute and deliver any certificates with respect to proceedings of the Town in connection therewith, and that the Treasurer and Chair of the Board of Selectmen, acting singly, be and hereby are authorized to execute and deliver on behalf of the Town such other documents and certificates as may be required in connection with such tax-exempt lease purchase agreement; and that no part of the proceeds of said tax-exempt lease purchase agreement shall be used, directly or indirectly, to acquire any securities and obligations, the acquisition of which would cause the tax-exempt lease purchase agreement to be a “private activity bond” or an “arbitrage bond” within the meaning of Sections 141 and 148, respectively, of the Internal Revenue Code of 1986, as amended (the “Code”); and that the Treasurer and Chair of the Board of Selectmen, acting singly, be and they hereby are authorized to covenant on behalf of the Town to file any information report and pay any rebate due to the United States in connection with the issuance of said tax-exempt lease purchase agreement, and to take all other lawful actions necessary to insure the interest portion of the rental payments under and pursuant to the tax-exempt lease purchase agreement will be excluded from the gross income of the owners thereof for purposes of federal income taxation and to refrain from taking any action which would cause such interest portion of the rental payments to become includable in the gross income of the owners thereof.

  • Other Business
The Town Office will be closed Monday, September 1, 2014 and the Transfer Station will be closed Tuesday, September 2nd for Labor Day.  There will be no change in the curbside trash pick-up schedule.

The next Community Pot Luck Lunch is Tuesday, September 9, 2014 at 11:30 AM at Buxton Town Hall.  All ages are welcome.  Please bring something to share.  Call Tashia Pinkham, Recreation Director at 929-8381 for more information.


  • Public Comments and Questions
Chief Mike Grovo reminded everyone that school is starting up again, and asked people to watch their speed.  He said the Department will be doing radar details again.

Chief Grovo mentioned that he, Eulla Brown, her husband Dwayne, and Officer Kevin Champagne were at Buxton Center Elementary School the first night it was open for parents and their children to visit teachers and see their rooms.  He said they gave out pencils, calendars, coloring books all related to anti-bullying in school.  Chief Grovo explained that this is where the grant money goes, and said they will be doing the same thing at Bonny Eagle Middle School on September10th.

Chief Grovo reported that the Police Department had 8-10 complaints last night on spray painting on Skip Road, Proprietor’s Road, and up in the Bonny Eagle area.  Our police officers noticed it from their patrols in the area and some officers from the Cumberland County Sheriff’s Department came over to help them check the area.  The vandals hit a lot of places including Jack Memorial School but the custodians came out and got the painting cleaned up before school started.  Chief Grovo gave “cudos to the custodians” for the work they did.  He asked people to call if they see or hear anything going on.

Tomorrow night there will be a third neighborhood watch group meeting at the church in Chicopee.  Chief Grovo said there will be a pot luck dinner, and they will be going over some notes and updating people who were invited.  He said the neighborhood watch program is going very well.

Chief Grovo reported that the new cruiser is here and should be up and running in the next few weeks.  

Selectman Harmon asked Chief Grovo about the time for the pot luck dinner.  

Chief Grovo said dinner will be at 6:00 PM tomorrow night at the church.
